Rapid Medicine Website – User Agreement



Rapid Medicine website (hereinafter: “the website”) was created to assist you in gathering and maintaining your personal medical information.

By signing this agreement, you also declare that:


1. (a) You wish to use the website and purchase products or services currently offered and/or will be offered in the future.

(b) You have not received any medical treatment/service from Rapid Medicine Ltd. (hereinafter: R.M.) and/or its physicians, and/or its directors, and/or its employees, and/or anyone acting on its behalf. Therefore, no medical records have been created in your name.

(c) Any personal information provided through the website, even if unsaved, is provided by you and is obtained exclusively from you.

In using the R.M. website, you waive any claim, demand or complaint of any sort towards R.M. and/or its physicians, and/or directors, and/or employees, and/or anyone acting on its behalf.

(d) You wish to join the online service offered by the R.M., including ordering the “R.M. Card” (hereinafter: the card) and updating relevant details.

(e) You are well aware that SMS messages and/or emails will be sent to you to inform you, among other things, but not limited to, of online services that will be added and/or detracted from time to time.

(f) You are aware that the card is only valid for one year from the date of issuance. Towards the end of one year from the date of issuance, you must login to the website and fill out a new questionnaire. R.M. does not store any data pertaining to the obtained personal information beyond one year from the date of card issuance. Therefore, after one year from the date of card issuance, all the information you provided is deleted.

(g) You waive any medical confidentiality to the extent it is relevant to transferring your medical information to us; transferring it between relevant parties in our company; transferring it for the sake of printing your card, and transferring it to anyone authorized to provide treatment under any circumstances.


2. You may receive and/or perform online services for your minor children who are under 18 years of age – all within the stipulations of the law and subject to R.M.’s discretion.


3. Your partner/spouse agrees that you shall receive the aforesaid services also for your minor children, as mentioned above. You undertake to inform R.M. in the event of any objection on the part of your partner/spouse, and you hereby dismiss R.M. of any responsibility and/or liability for transferring information or not transferring it thereof, without the permission of your partner/spouse, should you not provide such notice. You also undertake to indemnify R.M. For any damage and/or expense incurred by R.M. for transferring such information without the permission of your partner/spouse, should you not provide such notice.


4. By signing this agreement, you also declare that:


(a) The “R.M. Card” will be sent to the postal address you provided unless you otherwise requested and the R.M. confirmed.

(b) You have sole responsibility for maintaining the security of access to this email, including the use of it by authorized people on your behalf alone, and you hereby absolve R.M. of any liability and/or responsibility thereof.


(c) From the moment the card has been delivered by registered mail or courier service, or from the moment it is handed to you in person or by proxy, R.M. shall not bear any responsibility for the loss or theft of the card.

(d) From the moment you place the order and pay, you are not entitled to any refund or credit.

“Cancellation of a transaction in accordance with the Consumer Protection (Cancellation), Htsa”a -2010 and Consumer Protection Act, 1981.” (Perishables)

5. Access to the medical information sent by you is only possible for authorized personnel on behalf of R.M. and is secured by various safety measures. Company customers have no way of accessing the information, and, actually, upon sending the questionnaire, it is impossible to revert to it.

6. Upon filling out the questionnaire, you must ensure the screen is unexposed to other persons or means. The disclosure of your personal information, whether intentionally or due to loss/theft or any other reason, may reveal sensitive medical information about you to unauthorized users.

In any case of unauthorized disclosure, you must notify R.M. immediately. R.M. will not be held responsible or liable for the loss, theft or disclosure of your personal information thereof.


7. The information on the website is personal and intended for you only. All data, including special tests and medical documents compiled by you, will be only accessible to you when filling out the questionnaire.


8. At the end of each session using the website, it is your sole responsibility to remove the information and/or identification credentials, and/or any other data that may allow unauthorized access to the information and/or service. You hereby release R.M. from any responsibility and/or liability for such unauthorized access.


9. Please note: Upon entering R.M.’s website, the information on the screen might be exposed to people around it, including family members and/or anyone nearby. Therefore, we strongly suggest not to leave your screen with your personal information visible, without being physically present.


10. Maintaining the confidentiality of the personal medical information provided by you on R.M.’s website is your own responsibility. As such, you hereby provide your final and absolute waiver of any claim and/or lawsuit against R.M. and/or its physicians, and/or directors, and/or employees, and/or anyone on its behalf, for the unauthorized use and/or disclosure of the information appearing on the R.M. website, caused by the delivery and/or loss of personal security measures, and/or the viewing of information which was not expressly permitted by you, including by family members.


11. R.M. or anyone acting on its behalf has and will have access to any information on the R.M. website, including your information and/or that concerns you personally, through a secured authorization only.


12. Concentrating and transferring the data to R.M., or anyone acting on its behalf, is your sole responsibility. Had there been an error in the information displayed on the website and/or in the product and/or service you purchased from R.M., through the website or otherwise; and had there been some medical information that concerns you but does not appear on the website and/or the products and/or services you purchased; then you must contact R.M. as soon as possible and update the information. R.M. will bear no responsibility in this regard. R.M. is also not responsible for the veracity of the data you deliver.


13. Any action based on information appearing on the website requires the approval of your attending physician  (and not R.M.’s physician or any other doctor on its behalf). R.M. will bear no responsibility for any action based on information that appears on the website.


14. The information provided on the website, to the extent provided, does not constitute, in any case, a substitute for medical advice and/or treatment as necessary. You shall have no claim/demand against R.M. and/or its physicians, and/or directors, and/or employees, and/or any party on its behalf, for the use you or a proxy make of the R.M. website, including transferring and/or withdrawing data.


15. General:

(a) Copyrights

All copyrights, intellectual property, including brand name and trademarks, website design, the content published therein by R.M., and any software, application, computer code, graphic files, texts and any other materials contained therein, are the sole property of R.M. alone.


None of the above can be copied, and/or published, and/or handed over to any third party, without the prior consent in written form, by R.M.


(b) Warning and Clarification 

 Any medical information appearing on this website is to be considered general information and should not be understood in any way as “medical advice,” and/or “recommendation for treatment,” and/or “a substitute for personal medical care.” The information on this website is general and cannot be customized to each person’s specific needs. For personal medical care, and/or medical advice, one must contact their physician.  


(c) Privacy Policy

R.M. adopts a strict data security policy to ensure its customers’ information confidentiality.

The website does not contain your personal medical information. This information, if stored, is safeguarded at R.M.’s system only, held on Microsoft AZURE servers. Google, Facebook and/or any other websites and/or entities have no legal access to that information.

By using this website, you waive any claim, demand or complaint of any sort towards R.M. and/or its physicians, and/or directors, and/or employees/or anyone acting on its behalf.

The information collected by the website, whether private and personal, or partially private and personal, such as, for example, email addresses, and/or the content of email correspondence to and from us, is not transferred to any third party unless required by law and/or by any authority permitted to do so, and/or for your litigation vs. R.M.

(d) Copying, distributing, publicly displaying or disclosing any of the information mentioned above to any third party is strictly forbidden unless R.M has provided its written consent.

(e) The maximum amount R.M. would pay in case of proven damage shall not exceed the price of the R.M. card.

(g) In the case of any litigation is required between the parties, it will take place in a Tel Aviv-Jaffa courthouse.

Intellectual Property
Your use of any Contents all is conditioned on your maintaining all copyright, trademark and other proprietary rights notices appearing on that information. By using this website you agree that all contents are the proprietary information of RAM and are protected by international copyright, patent, trademark and trade secret laws and that you will conform your access, copying and use of all Content to the purposes permitted hereunder. 

If you breach any of these Terms of Use, your authorization to use this website will automatically terminate and you must immediately destroy or delete any downloaded or printed material.
Without limiting the generality of the foregoing, and subject to the other provisions of these Terms of Use, you may not use, reproduce or distribute any image on this website without securing the advanced written consent of RAM. To request permission, send an email to [email protected], including your name, address and a description of your intended use or distribution and the image you would like to use or distribute.

Communications
All communications, emails, feedback, messages and other materials (subsequently referred to as communications) transmitted to this website will be treated as non-confidential and non-proprietary. However, all your personal medical information given by you for the creation of your RAM CARD or to the RAM FILE will be treated with our top possible confidentiality.

Governance
This website is operated and controlled from RAM’s offices in Israel. It can be accessed from any state in the United States and from other countries. The laws of Israel (without regard to conflicts of law provisions) applicable therein will apply to all matters arising out of or in connection with this website and your connection to and use of the website. Both RAM and you will submit to the exclusive jurisdiction of Israel and agree that any cause of action arising out of or in connection with these terms of use shall be brought only in the courts of Israel.
You agree that if you access this website from another jurisdiction that you are responsible for compliance with local laws. If any provision of these Terms of Use is held to be invalid or unenforceable, that provision will be deemed to be restated to reflect as nearly as possible the original intention in accordance with applicable law, and the remainder of terms of use will remain in full force and effect.

The terms of use for the Rapid Medicine Ltd. (hereafter “RAM”) site and privacy protection policy

Please read carefully these terms conduct the basic guidelines for using the RAM site. These are the terms you have to agree to, when ordering RAM CARD and using the site and the services serves as an agreement to the terms.

General terms of use

The information offered on the RAM site is general information only. 

By using the site, the user gives up on any lawsuit, demand or claim of any kind towards RAM and/ or the stuff of writers/ editors/ advisers for the site.

Please notice that using the various options of public sites such as facebook, twitter etc., might create a possibility of shared information. Thus it’s recommended not to share personal or sensitive information on those sites.

Copyrights

Full copyrights and intellectual property, including names and trademarks, comprising the site, the advertised content of RAM and any program, computer codes, applications, graphic files, text and any other material comprising the site- belong to RAM only. Copying, distribution, reffering to a third party or displaying it in public, without receiving, in advance, a written agreement on behalf of RAM, is strictly forbidden.

Privacy and data protection policy

RAM is taking all the necessary precautions to insure the protection of your information, which, by law, is classified as “privileged information”.
We treat the data protection issue in many different layers, as will be expanded below.

Your medical information is collected to the sole purpose of issuing your RAM CARD. 

The access and management of your information is granted under a strict authorization system solely to the medical staff and relevant personnel, who are responsible for the issuing of your RAM CARD.

The access to your information in RAM systems is monitored and controlled at all times. There is a possibility to view at any given point the information about the people reviewing or making any kind of modifications to it.

The data protection policy is being followed by RAM.  The entire RAM personnel are being constantly guided and briefed on the subject. 
Your personal information is not to be transferred to a third party unless it is necessary for the printing of your RAM CARD.
In a case of a transition of your personal information to a third party, RAM makes sure that the third party receives comprehensive security tests and the commits to the protection of your personal information.

The information is to stay in the possession of a third party only under legal restriction concerning the preservation of medical information.

Your information is safe and protected with us, however, the data which is stored in your computer or your cellular phone, should also be protected for it is your responsibility to protect it. For this purpose, we recommend you to use the necessary data protection tools (antivirus programs, “firewall”, codes and encodings and data encryption).
